These terms of service form a binding agreement between you and TrailMate 4WD governing your access to and use of the Service. By creating an account, subscribing or otherwise using the Service, you agree to be bound by these terms.
1. Your account
You must provide accurate details, keep your password secure, and be at least 15 years old. You are responsible for activity under your account. Tell us straight away if you think someone else has access.
2. Free plan and TrailMate Pro
The free plan gives you a limited number of trips and vehicles. TrailMate Pro unlocks unlimited trips and vehicles plus full checklist customisation. Prices are shown in Australian dollars and include GST where applicable.
3. Billing and renewals
- Subscriptions are billed in advance, monthly or yearly, through Stripe.
- They renew automatically until you cancel.
- We will give reasonable notice before any price change.
- Failed payments may result in your subscription being suspended or cancelled.
4. Cancellation and refunds
You can cancel any time from the Subscription section of your profile. Cancelling stops future billing and TrailMate Pro access ends immediately — you are not charged again, and your account returns to the free plan straight away. Your trips, rigs, checklists and photos are kept, but anything above the free plan limits becomes read-only until you subscribe again. Nothing in these terms limits your rights under the Australian Consumer Law — you are entitled to a repair, replacement or refund where a service fails to meet a consumer guarantee. 5. Your content
Your trips, checklists, vehicle details, spot entries and photos remain yours. You grant us a non-exclusive, royalty-free licence to store, reproduce and process that content solely to operate the Service for you and anyone you deliberately share it with. That licence ends when you delete the content or your account, except for backups we are still cycling out.
You must only upload content you own or have permission to use, and you must not upload anything unlawful, misleading, defamatory, offensive, or that reveals another person’s personal information without their consent.
6. Sharing spots, convoys and public content
You choose whether a bucket-list spot stays private, is shared with your convoy, or is published to other users. Publishing means other members can see the name, location, photos, rating and notes you attached to it — so do not publish anything you would not want public, and do not publish access details for private property or closed tracks.
Content published by other users is their content, not ours. We do not pre-screen it, it may be inaccurate or out of date, and you rely on it at your own risk. We may review, unpublish or delete user content, and suspend accounts, where we reasonably believe these terms have been breached or where we are required to do so by law.
If you see content that is inaccurate, offensive, infringes your copyright, or exposes private land or personal information, report it to support@trailmate4wd.com.au and we will review it promptly.
7. Acceptable use
- You must not interfere with, scrape or reverse engineer the Service.
- You must not resell, sublicense or share access to a paid account.
- You must not use the Service to breach any law, to trespass, or to damage the environment, public land, cultural heritage or private property.
- You must not upload another person’s photos, reviews or personal details without their permission.
We may suspend or terminate accounts that breach these rules.
8. Third-party services and links
The Service links to and works alongside third parties, including Stripe for payments, map and search providers, fuel-price websites and supermarket websites. Those services have their own terms and privacy policies, we do not control them, and prices, availability and data shown by them are theirs, not ours. We do not sell, book or supply campsites, permits, fuel or groceries — bookings and permits are always arranged directly with the land manager or operator.
9. App stores
Where you install the app through the Apple App Store or Google Play, those stores’ own terms also apply, and any subscription purchased through a store is billed and cancelled through that store’s account settings rather than through us.
10. Availability
We aim for reliable service but do not guarantee uninterrupted availability. Features may change, and offline data depends on your device. Always carry independent navigation and communication gear in remote areas.
11. No emergency or safety service
The Service is a planning tool. It does not monitor your location, does not alert anyone if you fail to return, and cannot summon help. In an emergency call 000 (or 112 from a mobile) or activate a PLB or satellite communicator.
12. Liability
To the extent permitted by law, TrailMate 4WD is not liable for indirect or consequential loss arising from your use of the app, including losses caused by relying on trip, fuel, cost or maintenance estimates or on content published by other users. Where liability cannot be excluded, it is limited to resupplying the service or paying the cost of resupply. Nothing in these terms excludes any right or guarantee that cannot lawfully be excluded, including under the Australian Consumer Law.
13. Suspension, termination and changes
You may stop using the Service and delete your account at any time. We may suspend or close an account that breaches these terms, and may change or discontinue features with reasonable notice where the change is material. If we change these terms, we will update the date at the top of this page and notify you in the app or by email for material changes; continuing to use the Service after that means you accept the new terms.
14. Governing law
These terms are governed by the laws of Western Australia and the Commonwealth of Australia, and you submit to the courts of that jurisdiction.
